What Muskegon County Felony Records Contain

Felony records from the 8th Circuit Court include the charging document, minutes of each court appearance, orders from the judge, and the final sentence. These documents build the complete picture of a criminal case from first filing to disposition.

A typical Muskegon County felony case file includes the following types of information: the defendant's name and date of birth, the specific charge and statute violated, the date of the alleged offense, names of the assigned judge and prosecutor, each hearing date and what happened, plea information if a plea was entered, trial information if the case went to trial, and the sentence if the defendant was convicted. Pre-sentence investigation reports may be in the file but are sometimes sealed.

Certified copies of judgments of sentence are often needed for background checks, expungement petitions, or post-conviction proceedings. The clerk's office can provide these for a fee. Plain copies cost less and work for most personal research needs.

Expungement of Felony Records in Muskegon County

Michigan law allows some people to have felony convictions set aside, which removes them from most public databases. The process is called expungement or setting aside a conviction. It is governed by MCL 780.621.

Under the law, most people with one or two felony convictions may apply after a waiting period. The waiting period starts when the sentence is complete, including probation and parole. Many nonviolent felonies qualify. Some offenses, including life felonies and certain assaults, do not qualify. The 2021 "Clean Slate" law expanded eligibility significantly. Under MCL 780.621g, automatic expungement applies to certain convictions after a set number of years without further offenses.

To petition for expungement in Muskegon County, you file with the 8th Circuit Court. The court sets a hearing date and notifies the prosecutor. The judge decides whether to grant the petition. If granted, the record is removed from public access. The Michigan Legal Help website at michiganlegalhelp.org has step-by-step guides and forms for filing on your own.

Note: Expungement removes the conviction from public records but law enforcement agencies may still access the original record in some cases.

FOIA and Public Access in Muskegon County

Michigan's Freedom of Information Act, found at MCL 15.231, gives you the right to request public records from government agencies. Court records are generally public under this law unless sealed by order or restricted by statute.

To request felony records under FOIA, submit a written request to the Muskegon County 8th Circuit Court clerk. The court must respond within five business days. They may grant the request, deny it with a reason, or ask for more time. Fees for copies and staff time may apply. Requests for records that are already in an online system may be referred to that system first.

Most felony case records are open to the public. Juvenile records, certain mental health evaluations, and victim information may be restricted. If your request is denied, you can appeal to the head of the agency and then to circuit court.
